ARBITRATION.   A DISPUTE RELATING TO THE CONTENT (INCLUDING ANY QUESTION REGARDING THE EXISTENCE, VALIDITY OR TERMINATION OF THESE DISCLAIMERS) SHALL BE FINALLY SETTLED BY ARBITRATION AT A MUTUALLY AGREED UPON LOCATION WITHIN THE DISTRICT OF COLUMBIA BEFORE A SINGLE ARBITRATOR ADMINISTERED BY JUDICIAL ARBITRATION & MEDIATION SERVICES, INC. ("JAMS").  IF JAMS IS UNABLE TO ARBITRATE THE DISPUTE, THEN THE DISPUTE WILL BE CONDUCTED UNDER THE COMMERCIAL ARBITRATION RULES OF THE AMERICAN ARBITRATION ASSOCIATION ("AAA") BEFORE A SINGLE ARBITRATOR.  JUDGMENT ON THE AWARD RENDERED BY THE ARBITRATOR MAY BE ENTERED IN ANY COURT HAVING JURISDICTION THEREOF. THE ARBITRATOR SHALL HAVE NO POWER OR AUTHORITY TO MAKE ANY AWARD THAT PROVIDES FOR PUNITIVE OR EXEMPLARY DAMAGES.  EACH PARTY SHALL BEAR ITS OWN COST IN CONNECTION WITH ANY ARBITRATION PROCEEDINGS.  THE PARTIES SHALL EQUALLY SHARE THE FEES OF THE ARBITRATION AND THE ARBITRATOR.  IN THE EVENT OF AN ARBITRATION, OR ANY OTHER LEGAL ACTION BROUGHT BY A PARTY WITH RESPECT TO A DISPUTE, THE PREVAILING PARTY SHALL BE ENTITLED TO RECOVER REASONABLE ATTORNEY’S FEES AND EXPENSES IN ADDITION TO ANY OTHER RELIEF DEEMED APPROPRIATE BY THE ARBITRATOR OR COURT.
